means a hardware appliance, obtained from or through Licensor, with Software embedded by Licensor, and which is listed on an Order Form under License Type “Lease” or “Purchase”. Equipment shall have the same meaning as Software where Software is or has been used elsewhere in this Agreement. Software embedded in the Equipment is licensed solely to enable the Equipment to function in accordance with its Documentation.
